Terms of use and sale
These terms apply to bemorin.com, to the products published under it (Planner, Sudoku, Prompt, Convert and Silence) and to the courses sold on bemorin.com. The seller is Ben Morin, as described in the legal notice.
1. Using the site and the free tools
- You may use the site and the free tools for any lawful personal or professional purpose.
- The tools run in your browser and keep your data on your device. You are responsible for your own backups: clearing your browser's site data deletes what is stored there.
- Do not attempt to disrupt the services, access them without permission, or copy paid content.
2. What you can buy
- Planner Plus: a one-time payment for one person, with no subscription. It includes the Plus features available now and those added later.
- Planner team gift: a link that activates Plus for each person who opens it, up to the number of seats bought. The link can be activated for 12 months.
- Almanack, the code: a licence to use the code of this site for one website, as set out in the licence that comes with the download.
- Almanack, Set up for you and Made for you: services for businesses only (a company, a freelancer or a sole trader), not for consumers. Each one is set out in a quote or an invoice, with its price, what is delivered and when.
- Courses: a personal, non-transferable licence to watch the lessons and use the course materials, for as long as the course is offered.
- Services (a product built with you, or advice, asked for through "Start a project"): for businesses only (a company, a freelancer or a sole trader), not for consumers. Each one is set out in a quote or an invoice, with its price, what is delivered and when.
Prices are shown on each product's page, with taxes included where stated.
3. Payment and invoices
- Planner purchases are sold through Creem, the merchant of record. Creem takes the payment, charges the VAT due and sends the receipt and invoice. A team gift can also be paid by bank transfer against an invoice.
- Services are invoiced to the business that ordered them and paid through Stripe, by card or bank transfer.
- Courses are paid through Stripe. You receive a receipt by email.
4. Delivery
- Courses are available as soon as the payment is confirmed.
- Planner Plus is available as soon as the payment is confirmed.
5. Right of withdrawal
If you are a consumer in the European Union, you normally have 14 days to withdraw from a purchase made online. One exception applies:
- Digital content supplied immediately (courses, Planner Plus, the Almanack code): when you ask for immediate access and acknowledge that you lose the right of withdrawal, the right ends once access begins.
When a product's page offers its own guarantee or refund, it applies as described there, in addition to your legal rights.
6. Problems with a purchase
If something does not work as described, write to hello@bemorin.com with your order details. You also keep the legal guarantee of conformity that applies to digital content and goods.
7. Course content
Videos, transcripts and materials are for the buyer's personal use. Do not share access links, download videos to redistribute them, or publish the content elsewhere.
8. Intellectual property
The website and its source code may not be copied. Products, texts, screenshots and course content are © Ben Morin, all rights reserved. Third-party names belong to their owners.
9. Liability
We take care to keep the services available and correct, but they are provided as they are. Articles and courses share experience and are not legal, financial or other professional advice. Nothing in these terms limits liability where the law does not allow it, nor your mandatory rights as a consumer.
10. Applicable law and disputes
These terms are governed by the law of the country where the seller is established, without depriving consumers of the protection of the mandatory rules of their country of residence. Before going to court, write to us so we can try to settle the matter together.
11. Changes
These terms may change. The version that applies to a purchase is the one published on the day you made it.
